If the necessary data is not provided, it may not be possible to proceed with the request, enter into or perform a given contract, or carry out a given transaction.

Giving consent to receive marketing communications or property alerts is optional and does not affect access to AGM’s other services.

7. Website hosting and Netlify

This website uses technology infrastructure provided by Netlify, including services related to website hosting and, where applicable, the processing of forms submitted through the site.

When a user submits a form through the website, the information may be processed through Netlify’s technology infrastructure before being made available to AGM.

The use of these services may involve the processing of certain technical data and of the data voluntarily entered into the forms.

8. International data transfers

Some of the technology providers used by AGM may process personal data outside the European Economic Area.

Whenever an international transfer of personal data takes place to a country for which the European Commission has not issued an adequacy decision, AGM will seek to ensure that the legally required safeguards are used, namely standard contractual clauses approved by the European Commission or another valid mechanism provided for under the GDPR.

Netlify states that it uses legally recognised mechanisms for international transfers, including, where applicable, the EU-U.S. Data Privacy Framework and standard contractual clauses.

Data subjects may request further information about the applicable safeguards at geral@agm-imobiliaria.pt.

9. Retention period

Personal data is retained only for as long as necessary for the purpose for which it was collected, without prejudice to retention periods required by law. In particular:

Enquiries or requests for information: data is kept for as long as necessary to handle the request and, as a rule, for a maximum of 24 months after the last contact, unless a contractual relationship is established in the meantime or there is another basis for retaining it.

Alerts and marketing communications: data is processed for as long as the data subject’s consent remains in place, and may be withdrawn at any time.

Contractual relationships and real estate transactions: data is retained for the duration of the relationship and afterwards for the periods necessary to comply with legal, tax, accounting or regulatory obligations, or to defend legal rights.

Prevention of money laundering and terrorist financing: documents and records subject to a legally mandatory retention period are kept for the period set out in applicable legislation, namely for 7 years, where that period applies.

Once the retention period has ended, data will be deleted or anonymised, unless its retention continues to be required or permitted by law.

10. Security and confidentiality

AGM adopts appropriate technical and organisational measures to protect personal data against destruction, loss, alteration, unauthorised disclosure or access.

Access to data is limited to the people and entities that need it to perform their duties or to provide the contracted services.

Despite the measures adopted, no electronic transmission or storage system can guarantee absolute security, so users should also take appropriate steps to protect their own communications and devices.

11. Rights of data subjects

Under applicable law, data subjects may, depending on the circumstances, exercise the following rights:

  • the right to access their personal data;
  • the right to rectify inaccurate or incomplete data;

  • the right to restrict processing;
  • the right to object to processing;
  • the right to data portability, where applicable;
  • the right to withdraw consent at any time for processing based on consent;
  • the right to lodge a complaint with the competent supervisory authority.

The exercise of certain rights may be limited where the retention or processing of data is necessary to comply with a legal obligation or to exercise or defend legal rights.

Requests to exercise these rights should be sent to: geral@agm-imobiliaria.pt

AGM may request additional information where needed to confirm the requester’s identity and to prevent the improper disclosure of personal data.

12. Complaints to the CNPD

Without prejudice to contacting AGM beforehand to clarify or resolve any question, data subjects have the right to lodge a complaint with the Portuguese supervisory authority: the Comissão Nacional de Proteção de Dados — CNPD (the Portuguese National Data Protection Authority).

13. Automated decisions and profiling

AGM does not use the data collected through this website to take decisions based solely on automated processing which produce legal effects concerning the data subject or similarly significantly affect them.

14. Cookies

The website uses cookies strictly necessary for it to function and to remain secure, which do not require consent.

With your prior consent, given through the banner shown on the website, audience analytics cookies (Google Analytics) may also be used, helping AGM understand how the website is used — for example, the number of visitors or the most-visited pages. You may withdraw your consent at any time by deleting the cookies stored in your browser or by contacting us at geral@agm-imobiliaria.pt.

Should other tools involving non-essential cookies be implemented in the future, this Policy will be updated.

15. Links to third-party websites and platforms

AGM’s website may contain links to third-party websites or services, namely social media, WhatsApp, external platforms or other services.

When you access those platforms, the processing of personal data also becomes subject to the policies and terms of the respective entities.

AGM is not responsible for the privacy practices of external websites or services it does not control.
